1.1 Company profile. The Golden Tree is a management, hospitality and infrastructure organization. Its activities include the management and operational coordination of brands and businesses, hospitality operations, concierge services, customer care, technical and administrative infrastructure, and operational security and emergency coordination. Spa, wellness and massage activities constitute one business area within this wider organization and do not describe its entire scope of operations. Operational emergency coordination does not mean the assumption of governmental functions or a general undertaking to provide medical emergency services.
1.2 AURIM. AURIM is the spa and wellness brand of The Golden Tree. Under this brand, services offered include day spa access, wellness, fitness, massages, memberships and complementary hospitality services. AURIM uses The Golden Tree's central administrative, booking, payment administration, customer service and operational functions. The AURIM brand is not itself a contracting party independent of the legal entity identified for the relevant transaction.
1.3 Legal entity. The contractual service provider for services offered by The Golden Tree under these Terms is The Golden Tree International Inc., acting through its Austrian branch in Vienna, Parkring 12A, 1010 Vienna, Austria; Austrian branch commercial-register number: FN 542638 y. Principal company's address: 1000 Brickell Ave, Ste 715, Suite 5074, Miami, FL 33131, USA; Florida registration number: P19000071213. A branch is not a separate legal entity. In these Terms, references to “AURIM” in relation to contractual rights and obligations refer to this provider.
1.4 Other providers. Where a particular product, especially a gift voucher, is expressly sold by another company, its full identity and role will be disclosed before the contract is concluded. The involvement of a payment recipient, payment service provider, hotel location or customer service team does not, by itself, replace the agreed contractual party. AURIM may not subsequently change the contracting party at its sole discretion.
1.5 Shared infrastructure. Internal units such as CCD, the Operations Center, Concierge, OCC and Golden Tree Guardian may carry out authorized tasks for AURIM. Other brands and businesses in the managed corporate environment, including HASEYO, EUROBAU or CATAPULTO, may also use central services. This does not give AURIM guests a right to services from those other businesses or create automatic joint liability. Shared infrastructure does not authorize unrestricted sharing of personal data.
1.6 Contact. The central website is AURIM.at. Reception telephone: +43 1 417 0001. Legal notices should preferably be addressed to office.at@tgt.eu.com. For internal handling, copies are requested at office.at@tgt.international, legal@tgt.eu.com and legal@tgt.international and, where applicable, office@goldentree.at. The effectiveness of receipt of a notice does not depend on its simultaneous delivery to every address. Other legally permissible means of communication and statutory rules relaxing formal requirements remain available.
2.1 These Terms apply to the offers and locations that expressly refer to this version before conclusion of the relevant contract. They do not apply merely because a logo is displayed, a hotel partnership exists or a business belongs to the same corporate environment. Their scope may also cover a white-label operation offered under a hotel or other location brand, provided The Golden Tree is identified as the provider of the relevant service and these Terms are validly incorporated.
2.2 They cover reservations made through websites, booking systems, payment links, email, telephone, reception desks and authorized intermediaries. For third-party platforms, the terms validly agreed there before purchase also apply. Conditions that impose additional obligations and were not previously agreed do not become part of a completed booking simply because the guest later checks in.
2.3 The order of precedence is: mandatory law and individual agreements actually concluded; then the specific booking or membership agreement and clearly identified product- or location-specific terms; and finally these Terms. Additional Golden Tree framework terms apply only if validly incorporated in their own right; their place in an internal corporate hierarchy gives them no automatic precedence over a guest's rights.
2.4 Internal employee manuals, work instructions, prioritization rules and undisclosed corporate policies impose no additional payment obligations or waivers on guests. Posted notices may specify lawful rules of use and safety, but may not retrospectively and unilaterally withdraw essential contractual services.
2.5 The version made available to the guest before contract conclusion applies to that contract. The booking confirmation includes the agreed conditions or transmits them in a form that can be saved. Merely changing a website later does not modify an existing contract.
3.1 The service owed is the service specified in the relevant offer and confirmation at the stated location. Admission rights, facilities, treatment durations, additional services and included amenities vary by product. Neither a membership nor a day ticket gives general access to every The Golden Tree brand or all partner hotels.
3.2 A massage booking and spa admission are separate services. Booking a massage includes pool, sauna or fitness access only where expressly stated. Conversely, an admission product does not automatically include a massage.
3.3 Opening hours, individual areas and permitted visit periods for a product are communicated for the relevant location. Necessary safety measures and short-term technical disruptions may affect particular areas. The consequences of material service restrictions are governed by Chapter 12; this provision does not constitute a general exclusion of claims.
3.4 A particular lounger, locker, professional or treatment room is owed only if expressly agreed. Safety limits and legally applicable maximum occupancy levels apply even to prepaid guests and members.
3.5 Food, beverages, products, personal lockers, additional concierge assignments and other extras will be charged separately only where ordered or validly agreed and where the price was communicated beforehand. Merely making an item available does not create an obligation to pay.
4.1 Consumer prices are quoted in euros including applicable VAT. Mandatory price components, the total price, payment frequency and, where applicable, total costs over a specified term must be clearly disclosed before contract conclusion. Voluntary tips are not part of the contract price.
4.2 Dynamic pricing. Prices offered before a binding contract may vary by season, date, time of day, demand, capacity, location and booking channel. Once agreed, the total price expressly confirmed for the individual booking governs. Subsequent price increases or cheaper offers do not automatically amend the contract.
4.3 Sales channels. Printed price lists, magazines and brochures expressly designated as on-site offers apply to the on-site transactions and validity periods specified in them. Website, email, platform and special offers may differ. Guests are informed of the price applicable to their chosen transaction before placing a binding order. Previously confirmed prices and individual pricing agreements are unaffected.
4.4 A mere price or display error does not entitle AURIM to increase the price or cancel a contract arbitrarily after conclusion. Statutory rights concerning mistake remain unaffected. If a price is individualized through automated decision-making using personal data, separate information will be given before conclusion; ordinary capacity-based pricing does not become personalized pricing merely because it is dynamic.
4.5 Hotel employees. Employees directly employed by a hotel within the Marriott brand portfolio or by a participating IHG hotel, including InterContinental, receive a 50% discount, on proof of eligibility, on the AURIM products, services and treatments to which this benefit applies and on membership tariffs of up to and including twelve months. Ordinary Marriott Bonvoy or IHG loyalty membership expressly does not qualify for this benefit.
4.6 Police officers presenting valid official service identification may receive a 25% discount on participating services. Institutional arrangements, including those with diplomatic missions or public authorities, are subject to separately confirmed terms. Naming an institution does not establish an official partnership or a general entitlement for its members. Discounts must not be granted to influence official decisions or contrary to binding gift-acceptance prohibitions.
4.7 Applying discounts. Eligibility must be declared before contract conclusion and, for online or email bookings, verified no later than before the service is used. The reference price is the price shown for the selected booking channel before any discount. Discounts cannot be combined unless expressly confirmed. Deposits, damages and purely monetary credits are not discountable services. Whether separate membership price components qualify for a discount will be shown in the specific total price before conclusion. Eligibility and conditions are re-checked for future contract periods.
4.8 Vienna City Benefits Club – New Customer Offers. Special membership rates and promotional conditions offered in cooperation with the Vorteilsclub der Stadt Wien (Vienna City Benefits Club) are available exclusively to new customers of the respective participating Golden Tree or AURIM Spa location. A new customer is defined as a person who has never previously entered into or held a membership at that location, including memberships held under a former brand or operating name. Former members are excluded from these introductory offers regardless of how long ago their previous membership ended. The promotional discount cannot be claimed again upon membership renewal or the conclusion of a subsequent membership agreement. Additional promotional conditions expressly disclosed before contract conclusion, including minimum membership durations and eligibility requirements, remain applicable. This provision does not retrospectively amend any previously concluded binding agreement.
5.1 A general inquiry is not a confirmed reservation. Before contract conclusion, the location, product, appointment or validity model, price, payment method and material change and cancellation conditions must be established. Special requests form part of the contract only if expressly confirmed.
5.2 Online booking. Before the payment-triggering order, the booking system presents the material contractual information. The button used to complete a paid order must clearly indicate the obligation to pay. An automatically generated message constitutes acceptance only if it expressly confirms a binding booking; a mere acknowledgment of receipt is identified as such. Payment and acceptance are coordinated unambiguously. Amounts collected without contractual acceptance will be refunded promptly.
5.3 Email and telephone. For bookings by email or telephone, the terms communicated before the binding declaration apply. A payment link sent later cannot retroactively change an agreement already reached. Contract information and acceptance will be confirmed on a durable medium. Payment links are used for secure payment processing and do not create a separate exception from consumer rights.
5.4 Anyone booking on another person's behalf must be authorized to make the relevant declarations. The person placing the booking becomes personally liable to pay only under a corresponding agreement; booking for another guest does not create blanket liability for everything that guest subsequently does. Any required consent from a minor's legal representatives must be obtained.
5.5 Guests should report any apparent error in the date, location, name or product promptly. Failure to check a confirmation immediately does not extinguish mandatory statutory rights. Changes to contact details required for service delivery must be notified.
6.1 Reservations must generally be paid in full in advance. Exceptions apply only where room charging has been expressly accepted, a corporate account has been confirmed, sufficient voucher security exists or the returning-customer privilege below applies. A non-binding provisional hold may be allocated to another guest before binding confirmation, provided its provisional character was clearly disclosed beforehand.
6.2 Accepted payment methods and deadlines are stated before contract conclusion. Direct debit, stored card details and subsequent charges require the applicable authorization. A card held on file is not a blanket authorization for arbitrary additional charges. Statutory objections, chargeback rights and payment-dispute rights remain unaffected.
6.3 Returning-customer privilege. Individuals who have personally spent more than €2,500 in actually paid, non-refunded eligible purchases during the preceding 18 months receive a personal limit of €450 in total for confirmed reservations that have not yet been paid. This limit means the aggregate value of all simultaneously outstanding bookings, not €450 per booking. Payment is due upon arrival and, at the latest, before the relevant service begins. The privilege is non-transferable and does not include cash withdrawals or payment after the agreed service appointment.
6.4 A no-show attributable to the guest on a reservation secured by this privilege suspends the privilege for new reservations. It may be reinstated after a further €2,500 in qualifying purchases has been paid following suspension, the general eligibility criteria are met and outstanding due amounts have been settled. A disputed or erroneous suspension may be reviewed by a person. Previously confirmed contracts are not retroactively amended.
6.5 A valid voucher may be reserved as booking security up to the amount of its available balance. Before confirmation, AURIM explains which amount will be held and under which validly agreed cancellation conditions it may be charged. Amounts not owed will be released, and the same sum will not be charged twice against both the voucher and another payment method.
6.6 In the event of culpable payment default, statutory default interest and necessary, actually incurred and appropriate debt-collection costs may be claimed insofar as proportionate to the debt. The contractual maximum for a documented additional internal collection measure is €35; it is not triggered automatically by every failed payment attempt. The burden of proving the relevant conditions and amounts is not shifted to the guest. Documented third-party bank chargeback costs may not also be charged as internal costs.
6.7 Where payment is overdue, the member receives a payment request with an understandable statement of account and an appropriate grace period. After 31 days, and following separate notice, an unpaid principal amount may justify a proportionate temporary suspension of access if AURIM continues properly to offer its own contractual performance and the statutory conditions are met. The suspension must be lifted promptly upon settlement. Statutory rights of retention or withholding available to the member remain unaffected.
6.8 Repeated failed payments do not automatically terminate the contract. AURIM may pursue due and legally valid receivables through legal counsel and the courts, especially after repeated default. A court payment order is not issued by AURIM itself. Three failed debits do not, by themselves, make all future contributions immediately due. Rights to extraordinary termination remain available.
7.1 The booking specifies the location, date, treatment start time, agreed treatment type and treatment duration. Standard treatment durations are 25, 50 or 80 minutes. Calendar blocks of 30, 60 or 90 minutes also allow for organization, guest turnover and preparation; they do not extend the promised hands-on treatment time.
7.2 AURIM assigns personnel. Requests for a particular person or gender are non-binding preferences unless an express binding undertaking is given. If such a selection is confirmed for a separate fee, it becomes part of the contract. Any subsequent unavailability is handled under Chapter 12; the guest need not accept a substitute that deviates from the agreed selection.
7.3 Qualified professionals are assigned in accordance with the offered service and required authorization. A booking on a platform does not, in itself, relieve AURIM of its responsibility as the agreed provider. Where a third-party service is expressly brokered, the other provider is identified before conclusion.
7.4 Simultaneous couples' treatments, a shared room or multiple therapists are guaranteed only if confirmed as binding service elements. Any special surcharge must be included in the disclosed total price before conclusion.
8.1 For date-specific massages and wellness treatments booked directly with AURIM, one complimentary rescheduling to an available alternative appointment is permitted if the request reaches AURIM at least 24 hours before the original start time. The local time at the service location applies. AURIM confirms the rescheduled appointment; until then the original booking remains in force unless otherwise agreed.
8.2 An alternative appointment should take place within twelve months of the original date. If, despite a timely request, AURIM does not offer a reasonable available alternative within that period, the guest's entitlement will not be forfeited solely because time has elapsed. Another period may be agreed.
8.3 The same service may be moved as part of this complimentary rescheduling without an additional charge merely because demand has increased. Where the guest requests a more expensive treatment, a different scope of services or a separately priced upgrade, the difference agreed in advance must be paid. A previously purchased higher-value service will not be replaced with a lower-value service without consent.
8.4 After the single rescheduling, there is no further contractual entitlement to a complimentary change. AURIM may offer further discretionary accommodations. A rescheduling does not exclude statutory rights of withdrawal, termination, remedies for non-performance or repayment.
8.5 For platform bookings and specially agreed hotel bookings, Chapter 18 and the relevant special conditions apply. A rescheduling made necessary by AURIM does not use up the guest's complimentary rescheduling allowance.
9.1 A statutory right of withdrawal, contractual cancellation and voluntary rescheduling are distinct rights. For genuinely date-specific leisure bookings, no general complimentary cancellation entitlement is granted outside expressly agreed special conditions. Chapter 11 governs statutory withdrawal rights.
9.2 If a service held ready is not used for reasons attributable to the guest, or is canceled outside any agreed free-cancellation option, AURIM may claim the agreed fee in accordance with the applicable statutory rules. Expenses saved, income credited from alternative use, and alternative income deliberately forgone will be taken into account. The same capacity will not be charged twice without appropriate credit. An itemized calculation requested by the guest must reasonably reflect these principles.
9.3 An individual complimentary cancellation option may be expressly agreed, in particular following an email inquiry. The inquiry alone does not create this option; the confirmed deadline applies. For eligible hotel room-charge massages, the special twelve-hour rule in Chapter 18 applies.
9.4 For fully prepaid appointments, absence is documented as a no-show no later than the end of the reserved service period. A technical status label in a system does not change contractual rights. Cases of termination without fault or otherwise protected by law are not automatically treated as chargeable no-shows.
9.5 Illness or private scheduling problems do not automatically establish a general right to cancel without charge; the specific contract, statutory rights and any confirmed discretionary arrangement are decisive. AURIM does not request unnecessary medical diagnoses. Where supporting evidence is required, an appropriate confirmation of the relevant limitation will generally suffice.
10.1 Where the guest is late for reasons attributable to them, the treatment ends at the originally confirmed end time. Only the remaining portion that can be safely and professionally performed is available. An extension, rescheduling or refund due to the guest's own lateness is not guaranteed; the financial treatment is governed by Chapter 9. AURIM may voluntarily accommodate the guest where operationally possible.
10.2 A delay caused by AURIM does not deprive the guest of the agreed treatment time without remedy. Full performance, an agreed substitute or an appropriate adjustment/refund will be offered. Rights in respect of material delay remain unaffected.
10.3 Appointments that are unpaid but nevertheless confirmed as binding remain binding. Reallocating a slot after only four minutes is permissible only for a hold expressly identified as non-binding and limited accordingly. An otherwise confirmed booking is not reclassified as a non-binding hold merely because advance payment has not been made, unless the agreed conditions allow that result.
10.4 A guest may request that any physical contact or treatment stop at any time. Staff will pause or stop if the guest experiences pain, unwanted touching, discomfort or safety concerns. Consent to treatment does not waive bodily autonomy. Payment consequences depend on whether there was voluntary non-use, an obstacle attributable to the guest or a deficiency in service or safety attributable to the provider.
11.1 Date-specific leisure services. Under Section 18(1)(10) of the Austrian Distance and Off-Premises Contracts Act (FAGG), genuinely date-specific leisure services agreed for a particular day or period, in particular corresponding day-spa admissions and wellness massages, are not subject to the statutory 14-day distance-contract right of withdrawal. This requires a genuine date or period agreed before conclusion; adding a date afterwards is insufficient. The rule applies irrespective of whether the contract was concluded online, by email or by telephone.
11.2 This exception does not apply to every AURIM product. For distance contracts involving memberships, open-value gift vouchers and other non-exempt contracts, the applicable statutory rights remain. Details for the service and credit agreements covered here are set out in Annex C. For separate purchases of goods, the product-specific information supplied before purchase applies; a voucher confirmation in PDF format is not exempt digital content solely because it is a file.
11.3 Early commencement of services. For a service contract subject to withdrawal rights, AURIM will begin performance before the withdrawal period expires only upon the consumer's express request. Separate information is provided regarding proportionate payment and the loss of withdrawal rights only upon full performance. A first spa visit does not amount to full performance of a longer-term membership.
11.4 Where a right of withdrawal applies to a contract concluded through an online user interface, AURIM will provide the legally required electronic withdrawal function during the withdrawal period. Other permitted methods of declaration remain available. Neither accepting these Terms nor making payment constitutes a blanket waiver of statutory rights.
12.1 In the event of staff unavailability, technical disruptions or a necessary closure, AURIM will inform affected guests without undue delay once the effects are known. AURIM will first offer equivalent substitute performance, a replacement appointment or an appropriate service at another location. Material changes to location, date or content require the guest's consent. Significantly greater travel distances will not be imposed unilaterally.
12.2 A guest is not required to accept a substitute appointment, change of location, gift or voucher in place of an existing statutory right to repayment in money. If the agreed service cannot be provided and no suitable alternative is agreed, payments not owed will be refunded without undue delay. Other existing statutory rights remain unaffected.
12.3 In cases of force majeure or measures imposed by authorities, liability for damages is governed by statutory requirements. The absence of liability in damages does not automatically entitle AURIM to retain payment for services not performed. For ongoing memberships, the duration of an outage and the extent of services affected will be appropriately considered; an extension of the contract will not be imposed as the sole remedy without the member's agreement.
12.4 AURIM may change future offerings that have not yet been booked. Changes to existing contractual services cannot be justified solely by a general reservation of organizational discretion. Material and reasonably foreseeable consequences of short-notice protective measures will be explained transparently.
13.1 Personal identification. Personalized admission entitlements are recorded under the confirmed name and verified at check-in. Correction of a simple spelling error before first use is complimentary. Changing the name to another person or splitting a multi-person product requires an appropriate agreement; correcting an obvious input error must not be treated as a new sale at full price.
13.2 Classic Entry Card (CEC). For an online purchase without a separate date selection, the immediately following calendar day is expressly displayed as the binding visit date before payment. No separate manual booking request is needed. AURIM genuinely reserves admission capacity for that date. If the date is unavailable, a supposedly valid booking must not be accepted; the customer must be able to select an available date before conclusion. On-site purchases may expressly be made for the same day.
13.3 A CEC permits one admission during the applicable opening hours on the confirmed date. Once the visit has ended, there is no entitlement to re-entry. Brief exceptions may be agreed with reception before departure. Failure to attend does not automatically result in a new admission entitlement.
13.4 Subsequent goodwill accommodation. After a missed visit, AURIM may grant a new personal replacement entitlement as a discretionary goodwill measure, with no entitlement to it having existed beforehand. The decision and the new entitlement are documented separately. An approved replacement is not treated as worthless merely because it carries no separate monetary amount; its redemption terms are communicated. Unless a shorter validity period has been individually negotiated, this contractual model provides for redemption within 30 years of the original purchase. An available date is agreed for the replacement visit; the original goodwill decision does not automatically entitle the guest to successive replacements.
13.5 Higher categories. Recommended, Couples and higher Entry Card categories generally permit multiple exits and re-entries on the confirmed visit date. One loan bathrobe per entitled person is issued for that day, not another bathrobe upon every re-entry. Replacement where necessary for hygiene reasons or due to a defect remains possible. Other included services are specified in the product confirmation.
13.6 Loungers. An available lounger or a particular position is not generally guaranteed. VIP guests may request a reservation by email at least 24 hours before their visit. A timely request alone is not a commitment; only an express confirmation makes the specified reservation binding. AURIM does not describe unconfirmed loungers as a guaranteed product feature.
13.7 High occupancy. Before check-in and use of the service, a guest who finds the actual occupancy excessive or sees that no unpromised loungers are free may ask staff to verify the situation and transfer the still-unused visit entitlement to another available day free of charge. Once confirmed, the original entitlement is not marked as redeemed. The replacement has the validity described in 13.4. For a package booked together, a transfer confirmed before the start normally covers the entire unused package. This is a specific rescheduling arrangement, not a general promise of unrestricted access on any day.
13.8 Voluntary rescheduling due to high occupancy does not, by itself, create an additional claim for reimbursement. However, if AURIM cannot provide the lawfully promised access or essential booked services, Chapter 12 and statutory rights apply. Paid tickets do not permit safety limits to be exceeded.
14.1 The standard massages and wellness services covered here are intended for relaxation, well-being and recreation. They are not substitutes for medical diagnosis, medical treatment or physiotherapy. Medical or other regulated services, if actually offered, are provided under the correct provider and professional designation and the separate terms required for them.
14.2 Before treatment, AURIM asks about known limitations relevant to the specific service. Guests should disclose, in particular, known allergies to products used, acute inflammation or infection, recent injuries or operations, pregnancy and other known significant risks. No comprehensive self-diagnosis is required. Guests need not disclose every unrelated medical detail.
14.3 Where suitability is uncertain, a contagious illness, open wound or another specific risk exists, a treatment may be refused, modified, postponed or made conditional upon appropriate medical advice. This also applies to risks associated with heat, water, cardiovascular strain or physical exertion. A previous visit is not permanent confirmation of medical suitability.
14.4 Pregnancy does not automatically exclude every wellness service; the type and timing of the service and individual risks must be considered. Treatments for minors are provided only where age-appropriate and with the necessary consent. There is no entitlement to unsafe or unoffered treatment techniques.
14.5 Desired pressure, body areas and treatment boundaries are agreed with the guest. Pain, numbness, dizziness, breathing difficulties, unusual skin reactions or other discomfort should be reported to staff immediately where possible. Staff must respond appropriately. Information about possible temporary sensitivity is not a waiver of liability for treatment errors.
14.6 In an accident or acute emergency, AURIM will arrange reasonable first aid and, where necessary, professional assistance. No blanket consent is requested for arbitrary future medical interventions. Guests are not under a general obligation to bear emergency or treatment costs caused by AURIM's own fault.
14.7 The financial treatment of a service not performed for safety reasons depends on its cause, allocation of responsibility, services actually provided and statutory entitlements. A health incident does not automatically forfeit all payments. The data-protection handling of health information is governed separately.
15.1 A package is offered as a whole in accordance with its agreed scope for the confirmed visit. Included massages must be coordinated with an available treatment appointment. A CEC-type admission entitlement alone does not reserve an unspecified massage slot.
15.2 Splitting a package across several visit dates is not provided for without a prior special agreement. Guests may request an exception by email from the central booking office before the service begins. Local staff at ordinary check-in are not authorized independently to promise additional complimentary follow-up treatments. Statutorily protected individual agreements and the rules on attributable representation are not excluded.
15.3 Walk-in package visit without a treatment appointment; no subsequent splitting. Included massages require a confirmed appointment. If a guest arrives without a confirmed treatment appointment and no massage is available, they are informed before check-in. They may retain the entire unused package for a suitable alternative visit date. If they nevertheless wish to use the spa facilities that day despite the unavailable treatment, the parties must expressly agree and document before admission that the package will be fully redeemed through that visit and no separate later use or credit for the unused massage component is provided. This consequence must be expressly explained before the guest decides. Splitting the package across several dates requires an exception separately agreed by email under clause 15.2 before redemption; it is not offered at ordinary check-in. This clause does not apply if AURIM is responsible for the cancellation of a previously confirmed treatment; clause 15.4 governs that case.
15.4 Cancellation attributable to the provider. If AURIM is unable to perform a previously confirmed package massage for reasons within its responsibility, the guest may receive today's spa admission free of charge as a special remedy while retaining the entire original package, insofar as not previously partially consumed, for a replacement appointment. This arrangement is documented and accepted by the guest. Statutory alternative remedies for non-performance remain available.
15.5 For multi-person packages, the entitlement is personal to the agreed participants. If only one person attends, that person does not automatically receive double the services or a second complete package visit. Unused components are dealt with under the specifically agreed cancellation and rescheduling conditions, not automatically attributed to the attending guest without examination.
16.1 Value vouchers, gift vouchers, Gift Credits and similar balances may, depending on the product, be issued by different clearly identified providers. The seller, issuer, permitted redemption locations, acceptance networks, scope of service, validity and other material terms must be displayed with the product before purchase and documented in the purchase confirmation.
16.2 The Vienna branch of The Golden Tree International Inc. and the same company in Miami do not become two separate legal entities merely because they have different addresses. A foreign seller or different product designation does not eliminate mandatory consumer rights.
16.3 The validly agreed special voucher terms govern the relevant product. Where an ordinary value voucher sold by AURIM itself contains no special information, the following default rules apply: use for offered services of the identified issuer; partial redemption with the remaining balance retained; a 30-year redemption period from issue; and no obligation to make an additional minimum purchase. No entitlement to unspecified partner locations arises. Previously promised acceptance locations will not subsequently be withdrawn arbitrarily.
16.4 Upon redemption, a monetary balance is applied against the price agreed for the service at that time before its purchase. A voucher for a specific service is assessed according to the exact service promised. These two product types are not exchanged without consent. A value voucher is not a promise that service prices will remain unchanged indefinitely.
16.5 Cash payment merely as an alternative to the desired redemption is not offered. Statutory withdrawal, repayment, non-performance and other monetary claims remain unaffected. A redeemable online value voucher does not become exempt from withdrawal solely because it is immediately issued as a PDF, personalized or credited to an account.
16.6 Vouchers are checked against available receipts, codes and records. A missing system entry alone does not prove forgery. Where a valid entitlement can be demonstrated by other means, an internal recording error does not extinguish it. Any additional payment requested temporarily while the matter is investigated is documented and, upon proof of double payment, refunded rather than necessarily converted into a new voucher.
16.7 If a code or physical certificate is lost, AURIM will assess whether it can be blocked and reissued upon suitable proof of entitlement. Redemptions already validly completed and the rights of good-faith third parties must be taken into account. A voluntarily agreed residual credit arising from a membership settlement is also governed by 17.12.
17.1 Individual agreement. The individual membership agreement identifies the location, entitled person, scope of services, start and end of the initial period, payment dates, total price, included amenities, optional extras, any agreed holiday entitlement and the renewal arrangement. Available tariff periods may be one, six, twelve or 24 months. Stating a number of months is not a substitute for clearly identifying the actual contractual dates.
17.2 Location restriction and nature of services. A membership is valid only at the expressly designated location, even where sold under a hotel or other spa brand. Included pool, sauna, relaxation, yoga and fitness areas are defined by the tariff. A restriction on sports training therefore does not necessarily render the entire membership unusable; however, medical suitability and the reasonable practical availability of other material services must be assessed in the individual case.
17.3 Activation and partial months. Membership is activated only after the initial amount due, including agreed one-off charges, has been received. If membership begins during a calendar month, the remainder of that month is calculated pro rata according to the actual number of days in that month. Thereafter monthly contributions are due in advance on the first day of each calendar month. Where the contract ends during a month, an appropriate pro rata calculation also applies. A partial starting month does not silently extend the expressly agreed term.
17.4 One-off price component. For membership tariff periods exceeding one month, the openly disclosed one-off price component on initial enrollment is €99. It is due with the first payment and is included in the total price disclosed before conclusion. It does not apply to the one-month tariff. For prepaid memberships, an expressly identified waiver may be agreed. It is not charged again upon a merely seamless renewal. It is not represented as payment for an additional service that is not actually offered.
17.5 Annual price component. In addition to ongoing contributions, the agreed annual price component of €49.99 is due in a separate payment transaction on the calendar date expressly specified in the individual membership agreement. It is not divided among twelve monthly debits. The first due date, further due dates during the term and inclusion in the total price must be disclosed before conclusion. If no date is agreed, AURIM will not set one unilaterally. If the membership ends before that date, no debit is made. For prepaid tariffs, the agreement expressly states whether this component has already been paid or remains separately due; double charging is excluded. The effects of an agreed suspension are specified in the agreement; without a special arrangement, no additional annual amount is charged for a period during which membership is fully suspended.
17.6 Payment models. A fixed-term membership paid in full in advance ends without automatic renewal. For the recurring monthly-payment model, renewal is governed exclusively by 17.7. The choice of payment method does not itself create a separate credit agreement. The principal service remains provision of the agreed facilities and services during the contract term, not mere technical activation of an account.
17.7 Renewal under monthly payments. If expressly agreed in the individual membership agreement, membership renews at the end of the initial period for the original tariff period specified there unless notice of termination is given at least 15 days before the period ends. AURIM undertakes to provide separate, demonstrable notice, sufficiently early before that deadline, of the actual end date, the last date for cancellation, the renewal period, its cost and the consequences of not canceling; notice is envisaged 30 days before the relevant period ends. Notice of termination may also be given earlier. Without the required timely reminder, renewal is not inferred merely from silence. Mandatory rights relating to disproportionate contractual binding periods remain unaffected.
17.8 Notice of termination. Termination may be notified to office.at@tgt.eu.com or through an expressly provided channel. AURIM will confirm receipt and the contract end date. Effectiveness does not depend on management approval or on copying additional email addresses. Declarations legally effective when addressed to an authorized recipient are not excluded by a purely internal allocation of responsibilities.
17.9 Existing-member tariff. A member with an uninterrupted membership may request continuation of their previous monthly rate before a newly agreed renewal. For documentation purposes, the request should be submitted by email before a new binding price agreement. Without such a request, an expressly agreed new tariff may apply. In a purely automatic renewal, however, a price increase not previously agreed cannot be introduced through silence or a mere debit. Once a new price has been validly agreed, a later request to return to the former rate does not, by itself, alter past periods. Erroneous debits and demonstrable individual agreements remain correctable. This Master Version does not conceal an additional general index increase.
17.10 Special termination grounds. Without prejudice to mandatory statutory rights, AURIM allows early termination in the event of permanent relocation, a material professional change resulting in sustained inability to use the location, or a prolonged medically certified unsuitability for the essential contractual services, where continuation is unreasonable in the light of the specific contract. Appropriate evidence may be requested; a diagnosis is generally unnecessary. Death ends the personal right of use under membership. Management assesses objective requirements but has no unfettered discretion to determine whether a statutory termination right exists.
17.11 Health-related limitations. A temporary restriction on one type of use is not automatically grounds for ending every spa membership. Duration, affected principal services and reasonableness are relevant. An injured guest is not required to continue solely because saunas or relaxation rooms theoretically exist where they are medically unsuitable or cannot meaningfully be used. A voluntary suspension agreement does not replace an existing mandatory right to terminate.
17.12 Voluntary early settlement with tariff adjustment. Outside statutory or expressly granted rights to terminate without charge, AURIM may offer immediate termination by mutual agreement. The starting point is the regular monthly tariff documented at original contract conclusion for the period actually used, calculated pro rata for partial months. The difference from the agreed tariff already charged is presented transparently before acceptance. Any additional amount claimed must in any event not exceed the contributions otherwise outstanding to the agreed period end; even this cap does not replace an assessment of the arrangement's actual fairness. The calculation does not become binding merely because a cancellation message was sent. The guest receives a separate settlement offer and may reject it without losing statutory rights. Under such an agreement, a positive remaining prepaid balance may expressly be converted into a transferable value voucher. Without consent, an existing right to repayment in money is not replaced. Acceptance network and redemption terms are stated in the settlement offer.
17.13 No retrospective charges in protected cases. Where statutory withdrawal has been validly exercised, termination for good cause is justified or AURIM is responsible for material non-performance, no retrospective short-term rate is imposed as a penalty for exercising legal rights. Charges for services already rendered and any prepaid amounts no longer owed are distinguished in accordance with applicable law.
17.14 Holiday entitlement. A holiday option may be agreed for prepaid memberships. It must be expressly recorded in the agreement before the relevant advance payment; absence alone does not subsequently create an initial entitlement. Specific holiday dates may then be requested by email during the contract term before the pause begins. Up to two continuous suspension periods are permitted in a rolling 15-month period. No fixed maximum length is prescribed; start date, end date and revised contract end date are confirmed. The pause extends the prepaid period of use by the same duration without charging the monthly contribution again for the added period. Ordinary use is suspended during a pause. Statutory rights due to illness, impossibility or other good cause are independent of this holiday option.
17.15 Personal use. Memberships are personal and generally non-transferable. A voluntary transfer or a transferable settlement voucher may be separately agreed. Possession of a membership card alone does not entitle another person to use the membership. Identity checks must provide a reasonable manual method to verify entitlement even during technical outages.
17.16 Optional extras. Personal long-term or VIP lockers, special Wi-Fi offers, concierge services and other paid options apply only where actually offered and described separately. Ordinary lockers are not permanent lockers. The scope, duration, additional price and termination terms of an option must be established before purchase.
17.17 Non-use. Merely choosing not to use a membership that has been duly made available does not terminate the obligation to pay. This does not apply to the provider's failure to perform, legally justified withholding of payment or valid contract termination.
17.18 Exclusion and settlement. A justified temporary exclusion or extraordinary termination for serious misconduct is governed by Chapter 20. Advance payments are not automatically forfeited in full. Services already performed, valid outstanding receivables, specific damage and amounts no longer owed are accounted for separately; a voucher replaces a statutory reimbursement claim only by voluntary agreement.
18.1 Room charges. Charging to a hotel room is available only where accepted by the relevant hotel. Room and authorization checks and payment approval may be required. A hotel room number alone does not constitute unlimited payment authorization. A lawful refusal of room charging leaves other offered payment methods available.
18.2 Hotel massages. For expressly accepted massage bookings made through hotel receptions with confirmed room charging, the following applies: cancellation at least twelve hours before the start is free of charge; if canceled less than twelve hours before the start or in the event of non-attendance, charges are calculated under 9.2 up to the agreed price. At Vienna Marriott, charging massages to a room is not offered under Annex A. Other services there may be charged to a room subject to hotel approval.
18.3 Platforms. Bookings through Treatwell, ClassPass and other intermediary platforms are subject to the platform and service conditions communicated for the particular transaction. Changes, cancellations and refunds are handled through the prescribed procedures. AURIM may not impose conflicting conditions retrospectively at check-in. A reservation that is only partly visible in the system will be checked appropriately.
18.4 ClassPass cancellations by AURIM. If AURIM must cancel a confirmed ClassPass massage, it will initiate the full reversal or return of credits prescribed by the platform. Rescheduling instead of reversal is possible only with the guest's consent and through a permissible platform procedure. An appointment already refunded is not kept on internal records as though still paid.
18.5 Additional goodwill. If a guest arrives despite being told of a cancellation only a few hours earlier, AURIM may, subject to availability, offer complimentary spa admission with one towel as an apology, particularly where a replacement appointment is also confirmed. This may not prevent the return of credits legally or contractually owed. After a refund has already been completed, there is no automatic additional entitlement to complimentary spa access. AURIM may also expressly offer this accommodation where a new booking is immediately confirmed. Other statutory rights remain unaffected.
18.6 Different sales-channel allocations are managed before bookings become binding. A confirmed reservation may not be canceled solely because a more profitable direct booking subsequently becomes available. ClassPass spa admission is not normally canceled for sales-related reasons; necessary safety measures remain possible.
18.7 Corporate and government customers. Different payment deadlines, discounts, approval processes or consolidated invoicing require an appropriate framework agreement. An individual does not become a business customer merely by entering a company name. Statutory consumer protection is not waived through an internal customer classification.
18.8 White-label services. Where The Golden Tree offers a massage at a facility operated under a hotel or other location brand, its actual provider role and applicable conditions are identified before contract conclusion. Hotel terms may govern other hotel-related services without automatically changing the AURIM service. Binding special agreements prevail over general conditions for the matter concerned.
19.1 Proper check-in is required before use. AURIM verifies booking, payment and, where relevant, membership entitlements. For personalized products, an appropriate photo ID may be requested for visual inspection. This does not amount to an agreement for routine complete copying of identification documents or retention of an official document.
19.2 Companions, visitors and persons requesting a tour require appropriate admission authorization. A booking for one person does not automatically cover other guests. Staff-only and technical areas must not be entered without permission.
19.3 The published location-specific rules apply to minors. At the Marriott location, sauna and fitness areas are available from age 16; until age 18, an accompanying adult is required. No blanket minimum age applies to the pool; responsible adult supervision is mandatory. For each child under six years of age, the location's house rules require two responsible accompanying adults. This is a specific location rule, not a statement about a generally prescribed statutory supervision ratio.
19.4 Accompanying adults must actually be capable of supervising and must provide the required direct supervision. A child must not be left alone in the facility while the responsible adults leave. In such a case, staff will first safeguard the child and call for necessary assistance. The responsible adults' future admission rights may be reviewed and, in the event of a serious breach, terminated because of the specific risk created.
19.5 Swimming aids and the presence of staff do not replace required supervision. The absence of a lifeguard does not remove the operator's statutory premises safety and organizational duties. Binding safety instructions and closures must be observed.
20.1 The spa is a place of quiet and relaxation. Guests must act considerately, follow hygiene and dress rules, and avoid noise, harassment, hazardous behavior and damage. Running, jumping or diving contrary to safety instructions, unauthorized manipulation of technical equipment and use of closed areas or equipment are prohibited.
20.2 Private photographs, video and audio recordings are generally not permitted in spa, changing, treatment and relaxation areas. Any express special permission must respect the rights of others. Telephone calls, loudspeakers and media playback must be avoided or restricted so they do not disturb other guests. Lawful preservation of evidence in a specific legal dispute is not excluded categorically.
20.3 Outside food and drinks are generally prohibited, except water in suitable safe containers. Food and drinks offered by AURIM and approved hotel room-service orders may be consumed only in designated areas. At Marriott, orders are placed through AURIM reception or the designated confirmed email channel. Appropriate exceptions for medical necessity will be accommodated. Glass and other breakable containers are prohibited in wet or high-risk areas where indicated.
20.4 Appropriate swimwear must be worn in pool areas. The locally communicated hygiene and clothing rules apply to saunas, steam rooms and fitness facilities. Showering before use, suitable towels or underlays in saunas, and clean training shoes in fitness areas may be required. Arrangements for recognized assistance services are made with due regard to statutory access rights.
20.5 Persons whose alcohol or substance use creates a specific danger or substantial disruption may be excluded from the affected activities. Physical violence, threats, sexual harassment, unwanted sexual acts, serious discrimination or deliberate damage justify immediate protective measures.
20.6 House rules and property access rights are exercised by the lawfully entitled operator. AURIM staff and expressly authorized hotel, security or management personnel may exercise those rights within the scope of their authority. A contractual declaration cannot confer rights over premises that the operator does not actually possess.
20.7 Minor infringements will generally first lead to a reminder or warning. Immediate intervention is possible in cases of substantial danger or serious breach. The time and geographic scope of a restriction must be proportionate to the circumstances. A location-wide or group-wide ban requires a specific legal basis of authority and objective justification; protected characteristics and the mere fact of making a justified complaint are not grounds for exclusion.
20.8 Guests must leave the facility by its published closing time. At Marriott that time is 22:00. Closing procedures announced in good time facilitate orderly departure but do not, without a special agreement, deprive guests of material usage time. Repeated or serious refusal may trigger proportionate access restrictions. The financial consequences of ending a membership are accounted for separately.
21.1 Lockers and access devices are provided only for the agreed usage period. CEC guests return their key when their visit ends. Guests holding higher Entry Card categories may keep their day-use locker during authorized breaks on the same day. Members return ordinary locker keys each time they leave; expressly booked permanent personal lockers are excluded.
21.2 Security deposit at Marriott. For a physical locker key, AURIM may require an appropriate movable item voluntarily agreed as security or, if none is provided, a cash deposit of €150. Payment by card is not offered for the cash deposit. Issuance, the item or amount and its return are documented and a receipt is provided. Official passports, identity cards and e-cards are not retained as standard security. Car keys, house keys or other accepted items are kept securely without being used or without accessing the data they contain.
21.3 Security is returned promptly after the key is properly returned. If a deposited item is lost, it will not be sold, unlocked or used unilaterally. Any necessary settlement, release or retention permitted by law is governed by the claims actually existing. AURIM's responsibility for items in its custody is governed by law.
21.4 Lost locker key at Marriott. For loss of a key attributable to the guest, the agreed lump-sum compensation for necessary opening, security and restoration measures is €150. The amount reflects typical overall costs and does not establish a penalty without fault. Proven lower or nonexistent loss is taken into account; statutory rights to judicial reduction remain available. No additional compensation exceeding this lump sum is charged for the same ordinary lost-key incident. Separate intentional damage constitutes a different category of loss.
21.5 Before a necessary manual opening, the user's entitlement is checked and the procedure documented. Destructive opening is carried out only when necessary and no reasonably available less damaging method exists. Items are handed over immediately to the entitled guest; a damaged locker remains closed until repaired. Another locker will be provided, subject to availability, for the remaining authorized usage time. Liability for avoidable damage to guests' belongings is not excluded categorically.
21.6 Application of deposit and subsequent recovery of the key. A cash deposit is applied against the valid lost-key claim under 21.4 and is not charged in addition. If the key is found and returned on the day of the visit by 22:00, the deposit is refunded in full provided that no necessary opening, security or restoration measures have generated costs by that time and no compensable damage has occurred. If, however, the locker has already necessarily been forcibly opened due to a loss attributable to the guest, or other necessary measures have been carried out, legitimate costs and losses resulting from those measures remain payable even if the key is found later. Return of the key alone does not then create an entitlement to repayment of an amount validly retained for those costs. This applies even where the key is returned on the same visit day. The amount and calculation remain governed by 21.4.
21.7 Unauthorized retention. If a member retains an ordinary locker key beyond the end of the visit, the key must be returned immediately. For further occupancy and organizational losses caused through fault, the maximum calculation is €35 for each commenced additional calendar day, capped at €460 per calendar month. Demonstrably lower loss must be taken into account; a period that no longer causes loss of availability is not charged further. A CEC guest who accidentally takes a key away and returns it within two hours on the same day will not be charged under the intended goodwill policy. Permanent key loss and mere retention are not charged twice for the same loss.
21.8 Loan textiles. Loan bathrobes, towels and other loan items remain the property of their lawful owner and must be returned. Normal use and ordinary wear are not damage. Where loss or damage is attributable to the guest, recoverable damages are calculated under applicable law; automatic charging of the current full new-purchase price is not agreed.
21.9 Exceptional cleaning. Ordinary cleaning is included in operating prices. Necessary documented special-cleaning costs may be charged for unusual soiling culpably caused by a guest. Simple special cleaning is charged according to actual cost, subject to a €150 cap. Broken glass, hazardous contamination or a justified need for technical remediation may lead to higher documented costs. The cause of the damage and calculation will be explained. An unavoidable medical emergency does not, by itself, automatically trigger a cleaning charge.
21.10 Items left in ordinary lockers after closing may be removed with documentation and stored separately. Operational storage for up to six months is envisaged unless statutory lost-property surrender rules, justified shorter handling of perishable items or other legal obligations take precedence. Ownership is not automatically forfeited after six months. Items are released upon suitable proof of entitlement.
22.1 AURIM provides agreed services with the required professional and organizational care. Statutory rights regarding defective performance and non-performance remain available. Guests are encouraged to report defects during their visit where possible so that they can be remedied; this does not create a blanket short exclusion period for claims.
22.2 AURIM is liable for legally attributable damage under statutory rules. Liability for personal injury is not excluded or limited. The same applies to other damage caused intentionally or through gross negligence, mandatory liability and responsibility for persons whose conduct is legally attributed to AURIM. This Master Version contains no general waiver of liability by guests.
22.3 Guests remain responsible for proper use, compliance with justified safety instructions and their own applicable duties of supervision. Contributory fault is assessed in accordance with the law. Awareness of general risks does not mean the guest accepts treatment errors, defective facilities or inadequate organization.
22.4 Guests should avoid bringing unnecessary valuables and should lock provided lockers carefully. Statutory liability for property brought onto the premises, in particular under the rules applicable to bathing establishments and comparable custody relationships, and for security items actually accepted for safekeeping, remains unaffected. A sign stating “No liability” does not extinguish such claims.
22.5 These Terms do not impose automatic full liability on any party for every action of accompanying persons, family members or other guests. Each party's own contractual obligations and statutory rules on attribution and supervision determine liability.
23.1 AURIM may send booking confirmations, invoices, proposed changes and contract-related messages electronically. A legally permissible notice does not become ineffective merely because a particular internal form or internal department was not used. For time-sensitive communications, the confirmed booking channels should be used; statutory rules governing receipt remain decisive.
23.2 Complaints may be submitted at the location or to office.at@tgt.eu.com. Receipt will be acknowledged and the matter forwarded to the competent department. Internal management review does not constitute a binding determination of statutory consumer rights. A justified public review does not require AURIM's prior approval.
23.3 Booking creation, modifications, rescheduling, cancellations and goodwill decisions may be logged with the date, responsible unit, booking channel and objective reason. AURIM does not treat these records as conclusive and irrefutable evidence against a guest. A centrally maintained guest profile does not replace a separate valid agreement for new products or locations.
23.4 Personal data are processed for the respective necessary contractual, legal and security purposes. Details of roles, recipients, periods and rights are set out in Annex D and in the actual location- and processing-specific information accompanying it. Acceptance of these Terms is not blanket consent to every processing activity.
23.5 Under the model envisaged in this version, biometric identification takes place only following prior separate express consent and active participation in a dedicated identification procedure. Non-consenting persons are not subjected to biometric measurement for comparison with a facial database. An equivalent and reasonable manual admission check without a surcharge remains available. The separate declaration appears in Annex E.
23.6 Security-related image capture, biometric identification and health data are distinct processing operations. Calling a recording “image processing” does not in itself exempt it from data-protection law. Signing house rules does not authorize generalized surveillance, unlimited retention or blanket unrestricted international access.
24.1 Austrian law is agreed for contracts covered by this Austrian Master Version. This choice of law does not deprive consumers of protection under mandatory rules that would apply without that choice. Required local supplements for services actually provided in other countries must be incorporated before contract conclusion.
24.2 Statutory rules on court jurisdiction apply to consumers. No exclusive United States jurisdiction is agreed for payment matters. For business customers, the court of competent subject-matter jurisdiction in Vienna may be agreed for disputes arising under this contractual relationship, unless mandatory rules provide otherwise.
24.3 AURIM will first examine complaints directly. If a consumer dispute cannot be resolved, legally required information about the competent alternative dispute-resolution body and willingness to participate will be provided on a durable medium. This clause does not claim a general obligation to participate.
24.4 The German version is the authoritative source version for Austrian offerings. Translations provided must not covertly alter promised rights. Individual agreements actually made in another language and legal rules governing clarity and interpretation remain unaffected.
24.5 New versions generally apply only to contracts concluded after their effective date. Existing contracts may be changed only on a valid statutory or specifically agreed basis. Publication alone and continued spa use do not constitute blanket agreement to arbitrary changes.
24.6 If a provision is invalid, it is not automatically rewritten into the widest legally permissible version. Applicable statutory rules apply instead; the continued validity of the remainder is governed by law. A general reservation of mandatory rights does not cure an invalid individual clause.
24.7 Website and brands. Rights in website texts, images, videos, designs, trademarks and other materials remain with their respective rights holders. Contractually or legally permitted use remains unaffected; unauthorized commercial reproduction or misleading use of third-party brands is prohibited. Reference to a hotel does not automatically imply corporate affiliation.
A.1 Location. AURIM Spa at Vienna Marriott Hotel, Parkring 12A, 1010 Vienna. The general AURIM Terms apply to the AURIM services identified accordingly. A hotel stay does not thereby become an AURIM contract.
A.2 Opening hours. Regular spa opening hours are 08:00 to 22:00. Guests must have left the area, including changing facilities and key return, by 22:00. Differently agreed binding services and necessary safety measures remain possible. Timely reminders of closing will be given.
A.3 Admission and amenities. CEC: one entry on the confirmed date, key returned when the visit ends. Higher Entry Cards: authorized re-entry on the same day, one loan bathrobe per person per day, and return of the day-locker key no later than final departure. Members: ordinary locker keys may not be retained beyond the end of their visit. Other included amenities are determined by the product confirmation.
A.4 Children. Pool use requires responsible adult supervision; for children under six, two adults per child. Sauna and fitness from age 16, with an accompanying adult until age 18. No dedicated lifeguard is promised. Separate action may be taken for specific safety risks.
A.5 Keys. The Marriott-specific €150 cash deposit or lump-sum lost-key compensation, and the limited retention charges under Chapter 21, apply only here. They do not automatically extend to InterContinental or other hotels.
A.6 Hotel billing. Massages are not charged to Marriott room accounts. Other approved goods, food, beverages and services may be charged to the room following hotel confirmation. Room-service orders for spa areas are coordinated through AURIM reception or the confirmed email channel.
A.7 VIP loungers. A reservation request may be submitted by email at least 24 hours before the visit. Without express confirmation, there is no entitlement to an available or particular lounger.
A.8 Reciprocal access arrangements. Time-limited or otherwise restricted reciprocal wellness access may be offered to guests or members of The Ritz-Carlton, Vienna and Marriott, for example in connection with announced maintenance, cleaning, construction work or special access days. A specifically applicable and confirmed agreement is required. This clause makes no statement about ownership, brand ownership or operational responsibility at the Ritz-Carlton location and does not confer permanent general access.
B.1 InterContinental. Ordinary access is available to eligible hotel guests and expressly approved Golden Tree VIP members. A Marriott day ticket or Marriott membership does not automatically grant access.
B.2 Available facilities, opening hours and the services included in the particular hotel offer are defined in the location information provided in advance. In particular, neither Marriott's scope of services nor its key charges are transferred to this location. These Terms do not introduce a €150 flat lost-key charge at InterContinental; statutory damages remain recoverable where applicable.
B.3 For confirmed hotel massage room charges, cancellation at least twelve hours before the start is free of charge. Later cancellations and no-shows are charged in accordance with 9.2. Suitable room-charge authorization is obtained before binding acceptance.
B.4 Other locations. For any other location expressly covered, the provider, service address, admission category, opening hours, included facilities, payment methods and different pricing and cancellation terms must be available before contract conclusion. An internal location designation or management assignment alone is not sufficient customer information.
C.1 Scope. This notice applies to service and credit contracts subject to withdrawal under the Austrian Distance and Off-Premises Contracts Act (FAGG), in particular relevant distance memberships and unrestricted value vouchers. It does not apply to date-specific leisure bookings validly exempt under Section 18(1)(10) FAGG. Goods sold separately require a notice tailored to delivery of the goods.
C.2 Right of withdrawal. You have the right to withdraw from a covered contract within 14 days without giving any reason. For service contracts and the credit agreements addressed here, the withdrawal period begins on the day the contract is concluded. To exercise this right, you must notify The Golden Tree International Inc., Vienna branch, Parkring 12A, 1010 Vienna, Austria, email office.at@tgt.eu.com, of your decision by an unequivocal statement, for example by letter or email. You may use the form below, but are not required to do so. Sending your notice before the deadline is sufficient. Statutory extensions of the period for failure to provide notice remain applicable.
C.3 Effects of withdrawal. Following valid withdrawal, payments covered by the contract will be refunded without undue delay and no later than 14 days after receipt of the notice. Refunds are made through the same payment method unless expressly agreed otherwise; no fees will be charged for the refund. A voucher will not be issued against your wishes in place of a monetary repayment owed to you.
C.4 Services already commenced. If you expressly requested commencement of the service during the withdrawal period and the statutory information obligations were met, an appropriate proportionate amount is payable for services actually performed before withdrawal. The calculation is based on the legally prescribed comparison with the agreed total price and, where relevant, market value, not on a retrospective punitive conversion to a higher monthly tariff. If statutory conditions are not satisfied, no such payment is due solely because a service was used.
C.5 Full performance. For paid services, the right of withdrawal ends upon full performance only under statutory conditions, including prior express consent to commencement and acknowledgment that this right will be lost. One visit under an ongoing membership is not full performance.
C.6 Online function. For covered online contracts, an easily accessible “Withdraw from contract” function, followed by unequivocal confirmation, is available during the withdrawal period. AURIM will promptly send an acknowledgment that can be saved, containing the declaration, date and time. Withdrawal is not limited to use of this function.

Status of this Annex. This Annex describes the guest-data processing model established for the new contractual framework. It does not replace complete website and cookie information or the required identification of other actual controllers. It may be put into use only once the relevant systems, access controls and deletion periods have been implemented accordingly. Procedures not performed, or performed differently, must not be represented as existing practice.
For AURIM processing described here, the controller is The Golden Tree International Inc., acting through its Vienna branch, Parkring 12A, 1010 Vienna. Data-protection requests and withdrawals of consent may be sent to office.at@tgt.eu.com. No appointment of a data protection officer is claimed unless one has actually been appointed and published with separate contact details. Hotel-operated monitoring, hotel booking data and independent platform activities may be controlled by another entity, which must be identifiable on site or through the relevant process.
For inquiries, bookings, memberships, admission entitlements and commissioned concierge tasks, necessary identity, contact, contractual, appointment, payment-status and service information is processed under Article 6(1)(b) GDPR. Statutory invoicing, tax and record-retention duties are based on Article 6(1)(c) GDPR. Article 6(1)(f) GDPR may be relied upon for proportionate fraud prevention, IT security, documented claim handling and suitable access protection, subject in each case to assessment of conflicting rights.
Optional advertising, biometric identification and voluntary longer-term health profiles are not based on a blanket contract signature. Each requires the appropriate separate consent where applicable. Health data additionally require a suitable exception under Article 9(2) GDPR, particularly explicit consent; Article 9(2)(f) may apply to necessary specific legal claims, and Article 9(2)(c) may apply in genuine emergencies. An ordinary wellness service does not become healthcare processing under Article 9(2)(h) merely because it is described as such.
Identification documents are normally presented only for identity or age checks. Only information necessary for that check and confirmation that it took place is recorded in the system. Complete copies, passport scans, e-card information or all document numbers are not routinely collected. Additional data may be processed only for a specifically explained necessary purpose supported by a valid legal basis. A guest profile does not automatically make all data available to other brands.
The internal “TGT Guest Identity” procedure is used solely to verify an existing personal admission entitlement. A consenting participant independently initiates a dedicated identification procedure. The facial characteristics necessary for verification are derived from an image and securely linked to a separate profile identifier. Any subsequent comparison is made against that person's previously selected profile; this model does not perform biometric comparison of everyone present throughout the premises.
Explicit consent is obtained before collection. Guests who do not consent may use a manual identity or membership check without additional charge. Non-consenting companions or passers-by must not be subjected to biometric processing. If technical constraints cause their templates to be created or compared nonetheless, the procedure must be modified before use or the biometric function disabled. Ordinary security image capture is assessed separately.
Raw images used for template creation and transient comparison features are deleted once the necessary processing has successfully completed and are not archived for other purposes. Persistent templates are kept securely within the European Economic Area (EEA). They are needed only during an active, actually used and consented admission relationship; for one-day guests, that relationship ends with the visit. Upon withdrawal or ending of participation, use stops immediately and deletion is initiated without undue delay, under normal operations no later than 72 hours. No opt-in marketing database or system for automatically identifying persons subject to access bans is built from these data. In this model, minors are not enrolled in the voluntary facial-recognition profile.
In separately signposted entrance and passage areas where objectively necessary, AURIM may process individual still images or sequences for security. Purposes are the specifically necessary protection of persons and property and investigation of defined incidents, not generalized analysis of behavior, performance, advertising or health. Images must not be captured from areas where recording is unnecessary. No such recording takes place in changing rooms, toilets, showers, saunas or private treatment rooms. Comprehensive capture of bathing or undressed persons is not envisaged. Audio recording is not part of this model.
The recording area, controller, purpose and means of obtaining fuller information are indicated before a person enters. Routine deletion takes place no later than 72 hours, and earlier where a shorter period is sufficient for the documented purpose. Recordings are not routinely reviewed in their entirety without cause.
In connection with a particular accident, damage, suspicion of theft or relevant dispute, necessary individual recordings may be preserved before deletion. The reason, legal basis, relevant images or sequence, access and review date are documented. Preservation ends when the specific evidentiary purpose ceases; pending proceedings and concrete necessary claim periods may justify longer restricted retention. There is no blanket special-law permission for indefinite photo archives. Statutory claims, Article 6(1)(f) and, where applicable in an actual case, Article 17(3)(e) GDPR may be relied upon only to the extent genuinely relevant.
Only known risks relevant to the treatment, necessary product tolerances, agreed adjustments and objectively necessary treatment events are recorded. Material changes should be disclosed before each treatment, and existing entries should be checked for accuracy. No comprehensive general medical record is created for ordinary wellness services.
A separate profile may be established for the voluntary reuse of selected allergy and preference information. Its accuracy and necessity are reviewed no later than twelve months after the last substantive confirmation, and it is deleted no later than 24 months after the last treatment without renewed confirmation. For ongoing care, the person may consent again before expiry; unlimited retention without purpose review is not agreed. Withdrawal ends optional reuse.
Necessary factual documentation of a specific treatment is kept separately from the convenience profile and without unnecessary diagnoses. Where a valid Article 9 basis exists, retention for handling specific claims is generally envisaged for up to three years; a dispute actually known to exist, a statutory duty or a separately documented necessary evidentiary purpose may call for longer limited retention. The general possibility of future claims does not justify lifelong retention of all health information. Truly medical treatments are subject only to the separate record-keeping obligations applicable to the specific responsible professional.
The Bratislava Operations Center supports central administration and technical infrastructure within the EEA. CCD Vienna may handle necessary booking, customer service and complaint tasks. Access is role-based, logged and limited to necessity. Technical administration does not automatically entitle a person to read all health information.
OCC Seoul may receive necessary general booking and service data for coordination tasks actually assigned to it, provided its recipient role and transfer basis have been established. For recipients within the substantive scope of the EU adequacy decision for the Republic of Korea, that decision may provide the basis for transfer. No general unrestricted access to biometric or health data is granted.
Golden Tree Guardian Abu Dhabi may receive necessary IT security information or, in individual cases, strictly limited incident data after legal and technical approval. Naming an internal unit does not replace identification of the actual receiving legal entity. Where there is a third-country transfer, suitable Standard Contractual Clauses, assessment of the receiving country's risks and necessary supplementary measures may be required. No general EU adequacy status for the United Arab Emirates is asserted. Such a transfer does not take place before this assessment has been completed.
Under this model, biometric templates, facial-reference data and ordinary health profiles are not made available to Abu Dhabi or Seoul for general administration. An exceptional, specific legal case requires separate assessment of a necessary, narrowly limited and lawful transfer. Access from the United States also requires a valid third-country basis where applicable; a US parent company has no automatic unrestricted access to all data.
Necessary recipients may include booking, IT, hosting and payment service providers actually used; professionals commissioned for a specific service; participating hotels; advisers; insurers; courts; and competent authorities. Their type and role depend on their actual involvement. Processing on behalf, joint controllership and independent controllership are not conflated. Internal system labels such as “TGT Internal Systems” do not replace required service-provider agreements or transparent information about recipients. Information on specific recipients and transfer safeguards, including the possibility of obtaining a copy where required, is provided to the statutory extent upon request to office.at@tgt.eu.com.
Contractual and accounting records are stored during contract performance and for relevant statutory retention or specific claim-handling purposes. Accounting and tax records are generally retained for seven years from the end of the relevant calendar year, and longer if required in pending proceedings. Accounting obligations do not justify retaining every facial image or item of health information for the same period.
Ordinary access logs unrelated to a particular incident are deleted or effectively anonymized after 90 days. Necessary booking, redemption and payment evidence is maintained separately according to its purpose. For vouchers valid over many years, minimal records of issue, remaining balance and redemptions are retained; a full history of the holder's movements is unnecessary for that purpose. Backups have restricted access and are overwritten on a documented short restoration cycle; deletion rules are reapplied following restoration.
Data subjects have rights of access, rectification, erasure, restriction, portability and objection where the statutory conditions are met. Consent may be withdrawn at any time for the future without affecting prior lawfulness. Objection to direct marketing is possible at any time. Requests are generally handled within one month; legally permitted and justified extensions are communicated.
There is a right to lodge a complaint with a data-protection supervisory authority, in particular the Austrian Data Protection Authority. Current contact details for the competent authority are available in the complete Privacy Policy. Erasure may be restricted for demonstrated statutory duties or necessary legal claims, with reasons explained for the individual case.
Necessary identity, contract and payment data are required to arrange the booked service and personal entitlement. Without them, conclusion or check-in may not be possible. Optional biometric or advertising data are not a general condition of admission. Where information essential for safe treatment is unavailable, the particular unsafe treatment may be withheld; this does not authorize a blanket request for all health information.
Billing, balance checking and returning-customer limits may be processed using automated systems. A decision with a significant adverse effect, particularly a long-term access ban or final refusal based on alleged misconduct, is not left exclusively to an automated facial match or system score. Errors and objections are reviewed by authorized persons. Pseudonymized identifiers alone do not make data anonymous; genuine anonymization must preclude identification.
Note: The following declarations are separate forms. Optional boxes are not preselected and are not bundled into a single mandatory consent. The “Universal Guest Agreement” records acknowledgment and is not a worldwide waiver of statutory rights.

I have been given access to the terms applicable to my booking and the location-specific safety and house rules. I will follow lawful safety instructions and my applicable responsibilities for supervising others. I understand that ordinary wellness services are not substitutes for medical diagnosis or treatment. I will inform treatment staff of relevant known risks and may request that treatment be stopped at any time. This acknowledgment is neither a release of liability nor blanket consent to data processing or biometrics.

[ ] I wish to use the separately explained TGT facial-identification procedure to verify my personal admission entitlement at the above location. I expressly consent, under Articles 6(1)(a) and 9(2)(a) GDPR, to the collection, template creation and verification described for that purpose. The no-cost manual alternative has been explained to me. I may withdraw my consent for the future at any time. It does not cover advertising, movement profiles, biometric processing of other guests or arbitrary future locations.

[ ] In addition, I wish the expressly selected treatment-related allergy, tolerance and preference details to be used for my future treatments in the EEA health profile described. I expressly consent to this optional reuse under Annex D.6. The information is checked for accuracy and, without renewed confirmation, this reuse ends no later than 24 months after my most recent treatment. Declining this convenience profile does not prevent an individual treatment that can otherwise be provided safely.
